2. Services Description
IT Shining provides digital services including but not limited to website development, mobile app development, SEO services, digital marketing, graphic design, and hosting services. Specific service terms are agreed upon in individual project agreements.
3. Project Agreements
All projects begin with a formal agreement outlining scope of work, timeline, deliverables, and payment terms. Changes to project scope must be agreed upon in writing by both parties and may affect timeline and cost.
4. Payment Terms
Payment terms are specified in individual project agreements. Generally, projects require a deposit (typically 30-50%) before work begins, with the remainder due upon project completion. All prices are in USD unless otherwise stated. Late payments may incur additional fees.
5. Intellectual Property
Upon full payment, clients receive ownership of all custom work created for their project. IT Shining retains the right to showcase completed projects in our portfolio unless otherwise agreed. Third-party assets (fonts, stock images, plugins) are subject to their respective licenses.
6. Client Responsibilities
Clients are responsible for providing accurate project requirements, timely feedback, and necessary content/assets. Delays caused by client inaction may affect project timelines. Clients must ensure they have rights to any content they provide to IT Shining.
7. Revisions & Changes
Each project includes a specified number of revision rounds as outlined in the project agreement. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Major scope changes require a new agreement.
8. Confidentiality
Both parties agree to maintain confidentiality of sensitive business information shared during the project. IT Shining will not disclose client information to third parties without consent, except as required by law.
9. Limitation of Liability
IT Shining's liability is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. We do not guarantee specific business results from our digital marketing services.
10. Warranties & Disclaimers
IT Shining warrants that services will be performed in a professional manner. We do not guarantee specific search engine rankings, traffic levels, or conversion rates from SEO or marketing services, as these depend on many factors outside our control.
11. Refund Policy
Refunds are evaluated on a case-by-case basis. Deposits are non-refundable once work has commenced. If IT Shining fails to deliver agreed services, refunds will be issued proportionally. Digital products are non-refundable once delivered.
12. Termination
Either party may terminate a project agreement with written notice. The client is responsible for payment for all work completed up to the termination date. IT Shining reserves the right to terminate agreements for non-payment or breach of terms.
13. Website Use
Users of https://www.itshining.com agree not to misuse the website, submit false information through forms, attempt unauthorized access, or use the site for illegal purposes. We reserve the right to block access to users who violate these terms.
14. Third-Party Links
Our website may contain links to third-party websites. IT Shining is not responsible for the content or privacy practices of these external sites.
15. Governing Law
These Terms are governed by the laws of Pakistan. Any disputes will be resolved through negotiation in good faith, followed by mediation if necessary.
16. Changes to Terms
IT Shining reserves the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
